Our registered address is 93 Soi Therdthai 19, Bang Yi Ruea, Thon Buri, Bangkok 10600, Thailand (93 ซอยเทอดไทย 19 ตรอกข้างโรงเรียนวัดโพธินิมิตร แขวงบางยี่เรือ เขตธนบุรี กรุงเทพมหานคร 10600). 1.2 These terms cover hhec-th.com and other domains operated by HHEC that display these terms. They govern website use, subject to proper notice and applicable rules on contract formation. They do not themselves create an appointment as broker, a property sale or lease, a property-management agreement, or a loan agreement. Those services require separate arrangements. 1.3 HHEC provides brokerage for buying, selling and renting houses and condominiums in Bangkok and Bang Phli, Samut Prakan; accepts owners' sale and rental listings; provides property management; assists with home-loan documentation and bank coordination; and presents developers' new projects. ### 2. Language and legal capacity 2.1 The Thai version governs if it differs from this English translation, subject to mandatory law. Nothing here removes statutory consumer or personal-data rights. 2.2 If you are a minor under 20 and have not otherwise attained legal majority, obtain consent from a parent exercising parental power or your lawful guardian before requesting services or submitting personal data. Transactions requiring a representative must be undertaken with the representative's lawful authority. See the Privacy Policy for consent rules concerning children. ### 3. Listings and indicative information 3.1 Property descriptions, photographs, plans, measurements, locations, prices, availability and project details are provided by owners, developers or other relevant sources and may change. Images and maps may be illustrative or approximate. Confirm current details, boundaries, title, condition, included items, fees and availability with HHEC and the relevant party before committing. Viewings are by appointment and subject to confirmation. 3.2 Listings, advertised prices, promotions and loan information are general invitations to enquire, not binding offers or guarantees of availability, price, condition, return, legal eligibility to own property, or completion of a transaction. A website enquiry or viewing request does not reserve a property. Binding terms arise only through the relevant parties' separate agreement and any legal formalities. 3.3 HHEC will take reasonable care in presenting information and correcting material errors brought to its attention. This clause does not excuse a misleading statement, an unlawful advertisement or any liability imposed by law. Loans and professional advice 4.1 HHEC assists with preparing documents and coordinating with Thai banks at your request. HHEC is not a lender, does not make credit decisions, and cannot promise approval. The bank independently decides eligibility, credit assessment, approved amount, interest, fees, collateral and other conditions. Rates and repayment examples shown on the website are indicative and subject to the bank's current terms. 4.2 General website information is not individual legal, tax, investment or financial advice. Obtain appropriate independent advice and verify documents and costs before buying, selling, renting or applying for finance. No statement here excludes a duty of care or responsibility that Thai law places on HHEC. ### 5. Brokerage, commission and other services 5.1 The scope of any brokerage or property-management service, commission rate, payer, payment trigger, expenses, cancellation arrangements and applicable taxes must be agreed separately in writing with the relevant parties before that service begins. These website terms impose no commission or cancellation fee merely for browsing, making an enquiry or requesting a viewing. 5.2 A separate service agreement governs that service, subject to mandatory law. These terms do not authorise HHEC to sign, accept an offer, receive a deposit or otherwise bind an owner or customer without the necessary separate authority. ### 6. Acceptable use and information you submit 6.1 Use the website lawfully and provide information that is accurate to the best of your knowledge and that you are authorised to share. Do not impersonate another person, submit fraudulent or abusive enquiries, send spam or malware, interfere with operation, bypass security or rate limits, attempt unauthorised access, or collect other people's personal data without lawful authority. 6.2 Do not reproduce listings in bulk, scrape in a way that infringes rights or disrupts the service, or use content or contact details for unsolicited marketing. Lawful uses permitted by statute remain permitted. 6.3 Do not submit identity documents, income records or sensitive personal data through website message fields. Loan documents are requested later through an appropriate separate process. HHEC may proportionately restrict abusive traffic or remove unlawful submissions to protect users and the service, subject to law; this does not remove accrued contractual or statutory rights. ### 7. Intellectual property 7.1 Website software, text, design, photographs, plans and other materials are owned by HHEC or the respective owners/licensors. Display does not transfer ownership. You may view and save reasonable copies for your personal property search and share listing links. Other reproduction, alteration, republication, commercial exploitation or removal of ownership notices requires the relevant rights holder's permission, except where law permits it. 7.2 Third-party trademarks, bank names and logos, developer brands and supplied photographs remain the property of their respective owners. Their appearance does not itself establish sponsorship, endorsement, an exclusive partnership, a bank agency, or permission for you to reuse them. 7.3 Information you submit remains subject to your rights. HHEC may use it only as necessary to handle your request and as described in the Privacy Policy or a separate agreement; no unrestricted public-content licence is imposed through these terms. ### 8. External links, maps and privacy 8.1 Links to LINE, Facebook/Messenger, Instagram, TikTok, YouTube, banks, developers and other external services lead to sites controlled by their operators. Their terms and privacy policies apply there. OpenStreetMap map tiles are provided through an external service; locations are guidance for enquiries and do not establish legal boundaries. 8.2 HHEC does not control independent third-party operations and does not guarantee their content or uninterrupted availability. This does not remove responsibility for HHEC's own selection, statements, disclosures or conduct where the law imposes it. 8.3 The website's Privacy Policy explains forms, cookies/browser storage, analytics, disclosures and data rights. Acceptance of these terms is not consent to optional analytics, newsletters, sensitive-data processing or overseas transfers requiring specific consent. ### 9. Availability and liability 9.1 We aim to keep the website usable but cannot guarantee uninterrupted or error-free access. Maintenance, network failures and events beyond reasonable control can affect access. We will take reasonable steps to address problems within our control. 9.2 To the extent fair, reasonable and permitted by Thai law, HHEC is not liable for loss caused solely by an independent third party or an event beyond HHEC's reasonable control where HHEC has used reasonable care. We do not impose a monetary cap or a blanket exclusion of all indirect loss through these terms. Causation, recoverable loss and any limitation are determined under applicable law and the facts. 9.3 Nothing excludes or limits liability for HHEC's own fraud, wilful misconduct or gross negligence, or for persons whose acts HHEC must legally answer for. Nor does it exclude liability for death, personal injury or harm to health caused intentionally or negligently where exclusion is prohibited, liability under personal-data or consumer-protection law, or any other non-excludable duty. The Unfair Contract Terms Act B.E. 2540, including sections 4, 8 and 10, applies: a term granting an unfair advantage is enforceable only to the extent fair and reasonable. ### 10. Changes and separate agreements 10.1 We may update these terms by publishing the revised version and effective date, with appropriate notice of material changes. Changes apply prospectively to website use and do not retrospectively change an existing transaction or separate service agreement. Any change requiring agreement under law will be subject to that requirement. 10.2 If a provision cannot lawfully be enforced, it applies only to the lawful extent, or is severed where appropriate; the remaining terms continue only so far as consistent with law and fairness. No severability wording validates an otherwise unlawful term. ### 11. Governing law and disputes 11.1 Thai law governs these terms. Disputes may be brought before the courts of Thailand having jurisdiction under applicable procedural and consumer law. No exclusive Bangkok venue or compulsory arbitration is imposed. Mandatory rights concerning jurisdiction and access to regulators remain available. 11.2 Please contact HHEC to seek a practical resolution if a problem arises. Contacting us first is not a condition for exercising a statutory remedy or filing a complaint. ### 12.
